BROOKE TURNER – BALANCE FITNESS AND NUTRITION

TERMS AND CONDITIONS

OBJECTIVE

To ensure that students are fully aware of the way in which student fees and refunds are to be handled, the following is Balance Fitness and Nutrition’s (BFN) policy and procedures on processing fees and refund requests.

POLICY

The policy information is transparent and ensures that all students are treated fairly and with integrity when applying for refunds. We advise that BFN abides by the Consumer Protection legislation and will at all times respect each Student’s consumer rights. Refer to:

  • Australian Consumer Law and Fair Trading Regulations 2012

  • WA Fair Trading Act 2010

In purchasing a ticket and enrolling to an in person or virtual course hosted by Brooke Turner, Balance Fitness and Nutrition, whether your ticket was purchased via our website or via a direct Invoice, whether your ticket was purchased by you personally or by someone on your behalf, in purchasing a Course ticket you are deemed to have accepted all our Workshop Policies, Terms and Conditions. The Course policies are as follows:

Payment Facilities: Booking payments can be made by the options available on the Balance Fitness and Nutrition Website SHOP. Payment will be considered to have been received once funds have cleared Balance Fitness and Nutrition’s bank account.

Fees and Charges: Upon receipt of your payment you will be issued with an electronic receipt and a confirmation email from our website verifying that you are enrolled in the Functional Fitness for Pregnancy and Post Partum course.

CANCELLATIONS

If you need to cancel your workshop registration for whatever reason, you must do so in writing, an email will suffice. We recognise that unforeseen personal circumstances may arise impacting your ability to attend our course(s), however Brooke Turner, Balance Fitness and Nutrition will not accept responsibility for these.

Cancellations (Outside 14 days) – Should you cancel your training commitment more than two weeks (14 days) prior to the training date, you will be permitted to choose one of the following options:

  • Reschedule your training to the next available, mutually convenient workshop. A $50 transfer fee applies and must be re-booked within 6 months.

  • Transfer your registration to a colleague to attend in your absence;

Cancellations (Inside 14 days) – Should you cancel your training commitment within the 14 days prior to the training date, no refund will be permitted, and you will forfeit the cost of the workshop.  You are however permitted to substitute a colleague for your reservation, to attend in your absence.  Brooke Turner, Balance Fitness and Nutrition will not be held liable for an attendees’ failure to cancel a booking within the specified timeframes. Any transfer of enrolments must be emailed in writing prior to the course.

Course Cancellations by Brooke Turner, Balance Fitness and Nutrition – While every effort is made to ensure Courses are offered as advertised, there may be instances where courses need to be rescheduled. Brooke Turner, Balance Fitness and Nutrition reserves the right to cancel or reschedule a course at its discretion. Where Brooke Turner, Balance Fitness and Nutrition must cancel a course, participants will be offered to reschedule their workshop to the next suitable session or a refund offered. Brooke Turner, Balance Fitness and Nutrition will not be held liable for any costs incurred from changing to a different date.

REFUNDS

Brooke Turner, Balance Fitness and Nutrition does not permit a refund of course fees once a booking has been made. All refund requests must be submitted in writing. Emergencies and/or hardships will be considered on a case-by-case basis. Any approved refunds will be issued within 60 days less a $50 administration fee.

A refund will only be paid if:

  • You have overpaid the fee. The amount to be refunded or remain on your file as a credit valid for 12 months from the original course date.

  • You have enrolled in a course that has been cancelled by BFN (Option to reschedule available). This excludes cancellations due to force major events.

  • The trainer/assessor has established that a reasonable adjustment cannot be made to student’s language, literacy, and numeracy requirements (full refund provided).

A refund will not be provided if:

  • The Student has previously rebooked their training

  • The Student has departed the course prior to course completion, students are not eligible for refund however may rebook to alternative day. A rebooking fee will be applied.

  • The Student does not attend the course

  • The Student fails to complete the course by cancelling or withdrawing their enrolment from scheduled training and assessment sessions on the day of the course

  • The Student has been expulsed from scheduled training and assessment sessions by breaching the required code of conduct

  • The Student has requested a refund after they have attended and completed the course.

  • The Student had failed to pay the course fees

Application: All Students will indicate upon enrolment into any qualification or unit of competency that they have read, understood and have accepted these terms.

Booking Transfers:

Students may not amend their currently enrolled course to a different course type and/or training location offered by BFN unless for compassionate, hardship or emergency reasons. These will be considered on a case by case basis and requests must be submitted in writing. BFN permits the substitution of another student for a booking, however this change needs to be made fourteen (14) days prior to course commencement and notified of in writing.

ATTENDANCE & ASSESSMENT

  • Students are required to be present for the entire duration and every module of the course to be eligible for certification.

  • Assessments are comprised of both theory and practical for this course. There are two practical components spread across each day. Students will be assessed on their exercise prescription and coaching of a ‘case study’ and given both immediate verbal and follow up written feedback on these practical assessments.

  • The written assessment is completed at the end of the course and comprises of a mix of 50 multiple choice and 13 short answer questions covering each module from the two day training, totalling to 110 points.

  • Students have 75 minutes to complete the assessment. Students will be required to complete the written course assessment with a score of 80% or greater to pass the course.

  • Students will be notified within seven working days of their score and then issued with a pdf copy of their certificate via email.

  • Should a student not achieve a score of 80% or greater in the initial written assessment, they will be provided with feedback and given an opportunity to re-sit the assessment for any incorrect answers in order to achieve a higher score and specified pass mark.

CONFIDENTIALITY AGREEMENT & COURSE CONTENT

  • By signing the agreement and enrolment form and enrolling into any course by Brooke Turner - Balance Fitness and Nutrition, I understand, acknowledge, and agree to the following:

  • All course content, including media, test questions, and answers are the exclusive and confidential property of Brooke Turner – Balance Fitness and Nutrition, and are protected by intellectual property rights and may not be reproduced in any way;

  • I will not disclose the test questions or answers, or discuss any of the content of the test materials with any person without prior written approval from Brooke Turner – Balance Fitness and Nutrition;

  • I will not record, copy, or share any aspect of the course content, media, or test, including, without limitation, any notes or other;

  • I will not sell, license, distribute, give away, or obtain from any other source other than Brooke Turner – Balance Fitness and Nutrition the contents of the course, course materials, or test questions or answers;

  • I agree that my obligations under this Agreement shall continue in effect after completion of the course and test, and, if applicable, and

  • I agree that any violation of this Agreement shall be considered a breach of the Terms & Conditions outlined in the document, thus nullifying my credential.
